1. Who you are dealing with
A full postal address for the seller is available on written request to the contact address above, and is provided as standard on invoices issued to institutional purchasers.
2. What you are buying
The Attending is a collection of digital documents, PDF, Word, Excel, Markdown and plain-text files, delivered as a downloadable archive. It contains written methods, document templates, note structures, prompts and checklists for clinicians who use general-purpose AI assistants for administrative and documentation work.
You are not buying software. Specifically, there is:
- no application, login, account, hosted service or integration;
- no plugin for any electronic health record system;
- no AI model, API access or compute of any kind;
- no ongoing service obligation beyond the update period described in section 5.
3. The clinical disclaimers, read this section
Non-negotiable
The Attending is not a medical device. It is not clinical decision support, not diagnostic software, and not a source of medical advice. It does not diagnose, does not generate differentials, does not recommend treatment, and does not assess capacity, consent or risk. These exclusions are deliberate and structural, not a limitation to be worked around.
- No clinician-patient or clinician-clinician relationship is created by your purchase or use of these materials. Nothing here is advice about the care of any individual patient.
- Nothing you buy makes any AI tool compliant with HIPAA, UK/EU GDPR, or any other data protection or health privacy regime. Compliance is a property of the tool, the contract behind it and your organization's approvals, never of a document you downloaded.
- Your employer's policies and your regulator's guidance always take precedence over anything in these materials. This package does not authorize the use of any AI tool inside your organization and does not purport to.
- You remain fully and solely responsible for every clinical decision you make, every word entered into a patient record, and every communication sent to a patient or payer, including any content you drafted with the assistance of an AI tool. That responsibility is the entire premise of this product; it is stated here so that it is also a term of sale.
- Do not enter identifiable patient data into any AI tool that your organization has not approved under a Business Associate Agreement or equivalent data-processing agreement. The materials explain this at length; the obligation is yours regardless.
4. Eligibility
These materials are sold to qualified healthcare professionals, students in a healthcare profession, and healthcare organizations. You must be at least 18 years old to purchase. The Practice Suite is licensed to an organization; the individual purchasing it warrants that they are authorized to accept these terms on that organization's behalf.
5. Price, delivery and updates

This is not a subscription. Nothing recurs, and there is nothing to cancel. If you ever see a recurring charge from us, it is an error, tell us and we will refund it immediately.
We may change prices at any time for future purchases. A price change never affects a purchase you have already made, and never retroactively reduces what you received.
6. Refunds
Thirty days, no questions, and you keep the files. The full policy, including scope, timing and how to request one, is on the refund page and forms part of these terms.
7. License and permitted use
Your purchase grants a perpetual, non-exclusive, non-transferable license. The complete grant, including what you may adapt, brand and use with patients, is set out on the license page and forms part of these terms. In summary:
- You may use, edit and adapt these materials freely in your own clinical practice, including adapting templates to your own service and using patient-facing materials with your own patients.
- You may not resell, redistribute, publish, share the files outside your licensed seats, or use them to train, fine-tune or build a competing commercial product or dataset.
8. Intellectual property
All content in The Attending, including its structure, methods, wording and design, remains the intellectual property of the seller. Your license does not transfer ownership. Clinical content you write into these structures is entirely yours and we claim no interest in it whatsoever.
9. No warranty
These materials are provided "as is." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that any particular time saving, clinical outcome, reimbursement result, audit outcome or regulatory outcome will follow from using these materials. We publish no measured time-saving figure precisely because we have not run a study that would justify one, and we would rather say so here than imply otherwise anywhere else.
10. Limitation of liability
To the maximum extent permitted by law, the seller's total aggregate liability arising out of or relating to these materials is limited to the amount you actually paid for them. We are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of profit, revenue, data or reputation.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
11. Acceptable use
You agree not to:
- share, resell, sublicense or publish the files beyond the seats you have licensed;
- present these materials, or derivatives of them, as your own commercial product;
- use them to train or fine-tune a machine-learning model, or to assemble a competing dataset or library;
- use them in any way that breaches your professional obligations, your employer's policies, or applicable law.
Material breach of this section terminates your license. In practice, we will contact you first, this clause is not a tripwire.
12. Support
Support is provided by email at support@theattending.net, usually answered within one business day. Support covers delivery, access, file problems and questions about how to use the materials. It does not and cannot include advice about the clinical care of any patient, and we will decline any question of that kind.
13. Changes to these terms
We may update these terms for future purchases. The version in force at the time of your purchase is the version that governs it, and the date at the top of this page tells you which that is. We will not apply a later, less favorable version to a purchase you already made.
14. Governing law and disputes
Your purchase is transacted by Lemon Squeezy, LLC as merchant of record, and the payment transaction itself is governed by their terms, to which you agree at checkout. These terms govern the license to use the materials.
Nothing in these terms deprives you of the protection of any mandatory consumer-protection law of your own country of residence, and nothing restricts your right to bring proceedings there where the law gives you that right. In practice, almost anything you might need, a refund, a re-delivery, a correction, is resolved by emailing us, and we would always rather resolve it that way than have either of us involve a court over a $99 purchase.
